Terms of Service

These Terms of Service ("Terms") govern your use of the intervalsystems.net website and the software, applications and services provided by Interval Systems LLC ("Interval Systems", "we", "us" or "our"), together the "Services". By using the Services you agree to these Terms. If you use the Services on behalf of a company, you agree on its behalf and confirm you are authorized to do so.

1. The Services

Interval Systems provides workforce software, including employee onboarding, electronic forms and signatures, record keeping, and related tools for staffing, payroll and hourly employers. Features may be added, changed or removed over time. Some Services may be provided under a separate written agreement with a customer; if that agreement conflicts with these Terms, the agreement controls.

2. Accounts and access

Access to staff and administrative areas is limited to authorized users. You are responsible for keeping your sign-in credentials secure, for all activity under your account, and for telling us promptly at info@intervalsystems.net if you believe your account has been used without permission.

3. Customer and employee responsibilities

Employers using the Services are responsible for the accuracy of the information they enter, for their own employment, tax, payroll and immigration compliance (including completing and reviewing Form I-9 and tax forms), and for having a lawful basis to collect and use their workers' information. Workers completing forms through the Services agree that the information they provide is true and complete to the best of their knowledge.

4. Electronic signatures and records

By signing a document through the Services, you agree that your electronic signature is the legal equivalent of your handwritten signature and that documents may be provided and kept in electronic form. You may ask the employer that sent you the documents for paper copies.

5. Acceptable use

You agree not to: misuse or interfere with the Services; attempt to access accounts, data or systems you are not authorized to access; upload unlawful, false or harmful content; reverse engineer the Services except as permitted by law; or use the Services to violate any law or the rights of others.

6. Intellectual property

The Services, including software, design, logos and content, are owned by Interval Systems LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. Customers keep ownership of the data they and their workers submit.

7. Third-party services

The Services may rely on or link to third-party services, such as hosting, messaging, document storage and payroll providers. Their use is subject to their own terms, and we are not responsible for third-party services we do not control.

8. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Interval Systems disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. The Services do not provide legal, tax or accounting advice.

9. Limitation of liability

To the fullest extent permitted by law, Interval Systems will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim arose, or one hundred U.S. dollars if you paid nothing.

10. Indemnification

You agree to indemnify and hold harmless Interval Systems LLC from claims, losses and expenses arising from your misuse of the Services or your violation of these Terms or applicable law.

11. Suspension and termination
